Conditions of participation in the “Wholey Cereals” competition

These are the terms and conditions for participation in the “Wholey Cereals” competition (“Competition”). This consists of the raffle of vouchers.

 2. General

These terms and conditions of participation apply exclusively. By participating, the participant accepts these conditions of participation as the conditions of participation that apply exclusively to his/her participation in the competition. Differing, conflicting or supplementary general terms and conditions of the participant do not become part of the contract, not even in part.

Every consumer is entitled to participate. S.d. § 13 BGB with residence in Germany who has reached the age of 18.

Employees of the organizer and their relatives are excluded from participation.

Participation via competition or registration service is excluded.

     3. profit

    The organizer is giving away 100 vouchers worth EUR 100 each among all participants

      76227 Karlsruhe. 

      The general terms and conditions of dm apply to redeeming the voucher.

         4. Participation requirements and period

        Participation in the competition takes place exclusively as set out below:
          1. The participant buys a “Wholey” cereal product from the organizer as the manufacturer (“Product”) in any branch.
          2. The participant then takes a photo of the receipt showing the purchase of the product and sends it, complete with date, to the number via WhatsApp +49 152 162 952 84. 
          The purchase of the product and the transmission of the photo must take place between July 4th, 2024, 0:00 a.m. and August 10th, 2024, 11:59 p.m. (CET) (“Participation Period”).

            5. Execution of the draw, notification of prizes and transmission of prizes

            The winners will be determined by a random drawing among all participants. After the competition has ended, each winner will be contacted via WhatsApp with the following (or a similar) note

              „Hi ✌️ Congratulations! - You are a*r of the winners of the Wholey Cereals competition. Yay!

              Please send us your name and address here on WhatsApp. We will then send your prize by post as quickly as possible.“

              If there is no response from the winner within a week of the organizer informing the winner, the claim to the prize will expire without replacement. In their own interest, participants should ensure that a spam filter does not prevent them from being informed of the prize notification.
                The prize will be sent to the winner by regular mail to the address provided. The winner bears the risk of transmission.

                   6. data protection

                  The personal data collected as part of the competition will be used by the organizer to carry out the competition, to notify the participant of a win and to send the prize. By participating in the competition, the participant consents to this data processing, Art. 6 Para. 1 lit. a GDPR.

                  In addition, by taking part in the competition, the participant agrees to receive advertising information from the organizer.

                  The participant can revoke the consent in accordance with section 6.1 or 6.2 at any time by sending a message to the organizer without giving reasons. This message can be sent, for example, by email to info@wholey.de or by sending the message "STOP" via WhatsApp. The legality of the processing operations carried out on the basis of the consent until the revocation remains unaffected.

                  As a person affected by the processing of personal data, the participant is entitled to the rights under Chapter 3 GDPR, namely the right to information, correction, deletion, restriction of processing, data portability and the right to object.

                  To carry out the competition, the organizer uses the WhatsApp Business service provided by WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. For this purpose, we collect and process the mobile phone number stored on WhatsApp, if provided, your name and other data to the extent provided. Your data will be transmitted by WhatsApp to Meta Platforms Inc. servers in the USA. For the USA there is a so-called adequacy decision i. S.d. Art. 45 GDPR of the EU Commission. Otherwise, the data protection declaration of WhatsApp Ireland Limited applies.
                    The organizer also uses chatrmin.com GmbH, A-3400 Klosterneuburg, as a technical service provider and processor.
                      Otherwise, the organizer’s privacy policy applies at https://wholeyorganics.com/pages/datenschutz .

                        7. Liability

                        The organizer is liable without limitation in the event of intent, fraud and gross negligence as well as in the event of personal injury. 

                        The organizer is liable for damages in the event of a slightly negligent violation of an essential contractual obligation (“cardinal obligation”), ​​limited to the amount of the foreseeable damage that is typical for the contract. In addition to the main contractual performance obligations, cardinal obligations within the meaning of this regulation also include obligations whose fulfillment enables the proper execution of the contract and on whose compliance the participant can regularly rely.

                        Otherwise, any liability on the part of the organizer is excluded.

                          8. Miscellaneous

                          The organizer reserves the right to exclude the participant from participation if they violate these conditions of participation.

                          The organizer reserves the right to cancel or end the competition at any time without prior notice and without giving reasons. The organizer makes use of this option in particular if proper execution of the competition can no longer be guaranteed for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons. 

                          Legal recourse is excluded. German law applies.
